This Privacy Policy explains how One Great Studio Company Limited (“1GS”) collects, uses, stores, transfers, erases and destroys your Personal Data (as defined below) by your use of our website (https://onegreatstudio.com/) and/or the provision of services (“Services”) by us to you. In this Privacy Policy, any reference to “we”, “us” and “our” refers to 1GS.

“Personal Data” means any data (whether stored in an electronic or printed form) relating to a living individual who can be identified:

  1. from the data; or
  2. from the data and other information in the possession of 1GS.
PERSONS RESPONSIBLE FOR COLLECTING AND PROCESSING YOUR PERSONAL DATA

Your Personal Data is collected and processed by 1GS on the basis of the performance of a business relationship to which you are a party or for the taking of steps with a view to entering a business relationship with you for the provision of Services.

  3. Other information relevant to the provision of the Services.

This is a non-exhaustive list which is reflective of the varied nature of the Personal Data processed.

WHO THIS AFFECTS

If you are a natural person, this will affect you directly. If you are a corporate client that provides us with data on your clients or individuals connected to you such as employees, officers or agents of your company in relation to the provision of Services by us, this will be relevant for those individuals, and you should transmit this document to such individuals or otherwise advise them of its content.

HOW 1GS USES PERSONAL DATA

We may use Personal Data for the following purposes:

  1. Where we need to perform the Services to you or where we are about to enter a business relationship with you to provide the Service.
  2. To manage and /or administer your relationship with our office, including processing payments, invoicing, or providing any ancillary services to you.
  3. To confirm your identity where such action is relevant for compliance purposes.
  4. To manage our relationship with you including providing updates, reminders, requests and directions relevant to our business relationship with you or our legal obligations.
  5. To protect the security of communication systems, websites and other systems, and to detect security threats, fraud or other criminal or malicious activities against our office or our customers.
  6. Upon receipt of instruction or request from you or any third party authorized by you.
  7. For the purposes of communication with you through approved channels of communications and where necessary to keep you up to date on the latest products, announcements, and other information.
  8. To provide you with newsletters, surveys, emails, updates and other general communications and marketing in the context of the sale of the Services offered by us or similar goods and services offered by us.
  9. For any purpose related and/or ancillary to any of the above or any other purpose for which the Personal Data of our clients is required by our office.
OUR LEGAL BASIS FOR PROCESSING DATA

The legal basis for processing personal data in relation to marketing is your consent. You have the option to request that we do not send any such communication to you. The legal basis for processing all other personal data is that it is necessary for the performance of our Services requested by you, it is necessary in order to protect your vital interests, or it is necessary for compliance with any legal obligation other than an obligation imposed by our contract with you.

HOW WILL WE SHARE YOUR PERSONAL DATA?

We will limit sharing of your Personal Data as follows:

  1. We may share your Personal Data with an affiliate or associated entity of 1GS on a confidential basis, who may only use your Personal Data for the purposes listed above and who will be bound by law or contract to protect your Personal Data and only use your Personal Data in accordance with our instructions.
  2. We may share your Personal Data with any government agency in Jamaica (including financial institutions and regulatory bodies) for the purposes of fraud and crime prevention purposes.
  3. We may share your Personal Data with any third-party to whom we assign or novate any of the rights or obligations of 1GS.
  4. We will otherwise only disclose your Personal Data when you direct us or give us permission to do so, when we are required by applicable law or regulations or judicial or official request to do so, or as required to investigate actual or suspected fraudulent or criminal activities.
  5. We may also use aggregated Personal Data and statistics for the purpose of monitoring website usage to help us develop our website and our Services. We may also share your Personal Data with a variety of the following categories of third parties as necessary:
    1. Our professional advisers such as lawyers, auditors and accountants.
    2. Professional indemnity or other relevant insurers.
    3. Regulators/tax authorities/corporate registries.
    4. Third parties to whom we outsource certain services including but limited to, document processing and translation services, confidential waste disposal, information technology systems or software providers, information technology support service providers, document and information storage providers.
    5. Third-party postal or courier providers who assist us in delivering documents related to a matter.

Please note this list is non-exhaustive and there may be other examples where we need to share your Personal Data with other parties to provide the Services.

CAN YOU REFUSE TO SHARE PERSONAL DATA WITH US?

Personal Data is received by us on a voluntary basis and upon request from us on the basis of us being in compliance with the laws of Jamaica. Where, however, you do not provide us with the Personal Data requested by our office, we may be delayed or unable to provide the Services to you.

SECURITY

We take appropriate technical and organizational measures to keep your Personal Data confidential and secure and your Personal Data is stored electronically. All of our officers, employees and independent contractors who have access to and are associated with the processing of your Personal Data, are obliged to respect the confidentiality of such Personal Data. We, however, do not make any representations or warranties that your Personal Data may not be accessed, disclosed, altered, or destroyed by breach of such safeguards. We will notify you immediately in the event of a security breach which includes your Personal Data.

PERSONAL DATA WE RECEIVE FROM CLIENTS ABOUT THIRD PARTIES

It is required by 1GS that, where our clients provide us with the Personal Data of third parties, such as their employees, directors of their companies, or other persons they may have dealings with, they must ensure that they are entitled to divulge the Personal Data to us and have obtained their consent to that disclosure. Our clients are further required that they should ensure that any disclosure by us of the Personal Data of such third parties, is permitted and no further steps are required by our office for such disclosure. More specifically, it is a requirement that when our clients disclose any Personal Data of third parties to us, such third parties should be aware of this disclosure, they should be made aware as to who we are, how their Personal Data will be used, what disclosure practice we have in place and the rights of any such third party to contact our office and to inquire about the purposes for which we collect data, what our disclosure practices are and the rights of the any such third party in relation to our holding of their data.

TRANSFER OF PERSONAL DATA

There may be circumstances in which your Personal Data would be transferred to a territory outside of Jamaica such as the United States of America and such territory may not provide for an adequate level of data protection as granted in Jamaica. When making such transfers, we shall ensure that they are subject to appropriate safeguards in accordance with any applicable data protection legislation. Your consent must be given for such transfer of Personal Data, and you should not hold us liable for the manner in which your Personal Data is held or processed by any third parties which are situated outside Jamaica. 

RETENTION OF PERSONAL DATA

We will generally retain your Personal Data provided to us either physically or electronically during our business relationship for a period as may be reasonably necessary to fulfil the purposes it was collected for including legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe it is necessary including but not limited to the prospect of litigation in respect of our business relationship with you. Thereafter our files may be destroyed, and we are not obliged to provide you with any notice of such destruction.

You must inform us immediately where your Personal Data has changed, or where you believe that the Personal Data we hold is inaccurate. Our office will not be held responsible for any loss that may arise due to us having any inaccurate, incomplete, or otherwise deficient Personal Data which you or any third-party entity have provided to us.

CHANGES TO THIS PRIVACY POLICY

We may make changes to this Privacy Policy from time to time. To ensure that you are always aware of how we use your Personal Data we will update this Privacy Policy from time to time to reflect any changes to our use of your Personal Data. We may also make changes as required to comply with changes in applicable law or regulatory requirements. Where it is practicable, we will notify you by email of any significant changes. However, we encourage you to review this Privacy Policy periodically to be informed of how we use your Personal Data.

Our website, newsletters, email updates and other communications may, from time to time, contain links to and from the websites of others. The Personal Data that you provide through these websites is not subject to this Privacy Policy and the treatment of your Personal Data by such websites is not our responsibility. If you follow a link to any other websites, please note that these websites have their own privacy notices/policies which will set out how your Personal Data is collected and processed when visiting those sites.
